Article 1 — Scope
These terms apply to all distance sales of home appliances on this website operated by BURJ SPRL (Atelier Kelvin brand).
By placing an order, the customer accepts these terms without reservation.

Article 3 — Products, availability and prices
- Key product features are listed on product pages.
- Prices are displayed in EUR, VAT included unless otherwise stated.
- Shipping fees are shown before final order confirmation.
- In case of obvious price/availability error, the order may be paused and clarified with the customer.
Article 4 — Ordering process
Atelier Kelvin may reject orders in case of fraud risk, unpaid debt, or inconsistent information.
- Add products to cart and confirm order summary.
- Provide shipping/billing details.
- Select payment and explicitly confirm order with payment obligation.
- Receive order confirmation by email.
Article 5 — Payment
- Available methods: Mollie and bank transfer.
- Capture/settlement follows payment provider rules.
- Fraud checks may require additional verification.
- Order is confirmed after valid authorization.
Article 6 — Delivery
- Delivery countries: 92 countries: Europe, the Americas and Oceania (excluding Asia/Africa), including Ukraine, Russia and Belarus.
- Main carriers: DHL / DPD.
- DPD is offered for eligible countries and billable weight; DHL remains available for all allowed destinations.
- Maximum announced lead time: 14 calendar days (except force majeure).
- Risk remains with seller until physical delivery to customer.
Article 7 — Withdrawal and returns
- Consumers have a statutory withdrawal right of 14 days after delivery.
- Atelier Kelvin standard workflow: return request within 12 days.
- Standard commercial policy: unopened, complete and resale-ready item.
- Between day 13 and day 14, requests remain possible under legal withdrawal rights via support email.
- Return shipping is paid by customer, except defective, damaged-on-arrival or non-conforming items.
Article 8 — Legal warranty
Products are covered by applicable legal conformity warranty (minimum 2 years for new goods).
In case of non-conformity: repair, replacement, price reduction or contract termination under applicable law.
Article 9 — Liability
Atelier Kelvin liability is limited to foreseeable direct damages linked to contract performance, except mandatory legal provisions.
Product visuals, manuals and availability may change without prior notice.
Article 10 — Personal data and cookies
Strictly necessary personal data is processed according to the privacy and cookie policies.
No marketing cookies are placed by default.
Article 11 — Complaints and disputes
Complaints must first be sent to support@atelier-kelvin.fr.
If amicable resolution fails, customers may use competent ADR channels in Belgium (including the Consumer Ombudsman service).
The EU ODR platform has been discontinued since 20 July 2025.
Article 12 — Governing law and jurisdiction
These terms are governed by Droit belge.
In absence of amicable resolution, jurisdiction follows applicable law, including Tribunaux de Bruxelles when competent.
Article 13 - Electronic evidence and record retention
- Technical logs, confirmation emails, order records and payment references may be used as evidence between the parties unless proven otherwise.
- Contract records are retained on durable media for the period required by legal, accounting, tax and rights-defense obligations.
- Customers should keep confirmation emails, invoices and shipment references sent after order validation.
Article 14 - Force majeure and temporary suspension
Neither party is liable for delay or non-performance caused by force majeure under applicable law (natural disaster, major logistics blockage, large-scale network outage, authority decision, external labor conflict).
During a force majeure event, affected obligations are suspended. Parties cooperate in good faith to reduce impact and keep customers informed.
Article 15 - Severability and no waiver
If any provision is held invalid or unenforceable, remaining provisions remain fully effective.
Any temporary failure by Atelier Kelvin to enforce a clause shall not be interpreted as permanent waiver.

- Full pre-contractual information before order validation (price, fees, delivery, warranties).
- Consumer 14-day withdrawal right and legal conformity warranty are preserved.

Additional legal clauses
- Evidence and timestamping: technical logs and confirmations issued on durable media may be used as contractual evidence, unless proven otherwise.
- Notices: contractual communications are deemed validly served when sent to the email address provided by the customer at order or account creation.
- Severability: if one clause is declared invalid, the remaining provisions remain fully enforceable.
- Proportionate retention: contractual records are retained only for applicable legal obligations and legitimate rights defense.
